Lead-Based Paint
Homes built before 1978 may contain lead-based paint, and sellers are required by federal law to disclose any known information about lead hazards. This pamphlet explains what sellers must provide, what buyers are entitled to receive, and how lead-related disclosures fit into the transaction. Reviewing this information helps sellers understand their responsibilities and complete required disclosures accurately and on time.
Radon
Radon is a naturally occurring, odorless gas that can be present in homes of any age. Sellers may be required to provide radon-related disclosures depending on the transaction and local guidelines. This information explains what radon is, how disclosures work, and how testing or mitigation requests are typically handled during the selling process, helping sellers understand expectations and avoid surprises.
Lead-Based Paint
(Illinois / Federal Disclosure – Form 420)
Federal law requires sellers of residential property built before 1978 to provide buyers with specific information regarding lead-based paint and lead-based paint hazards. This disclosure documents whether the seller has knowledge of lead-based paint, whether any related records or reports exist, and confirms that the required educational pamphlet has been provided to the buyer. The purpose of this disclosure is to ensure buyers receive required information prior to entering into a contract.
Radon
(Illinois Form 422)
Illinois law requires sellers to disclose any known information regarding elevated radon concentrations in the property and to provide buyers with the state-approved radon information pamphlet. This disclosure addresses whether the seller is aware of elevated radon levels and whether any testing records exist. The form is designed to document the exchange of information and acknowledgements between the parties as part of the transaction.
Residential Real Property Disclosure Report
(Illinois Form 108)
This disclosure is required under the Illinois Residential Real Property Disclosure Act and is intended to inform prospective buyers of material defects that the seller is aware of at the time the disclosure is completed. The report reflects the seller’s actual knowledge of the property’s condition and does not require inspections or investigations. Sellers have a continuing obligation to supplement the disclosure if they become aware of new information prior to closing. Because this form carries legal obligations, sellers may wish to review it carefully and consult an attorney with any questions.
